WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE COOKIES?

According to the AEPD (Spanish Data Protection Agency) Guide of July 2023, taking into account the information and criteria provided by the European Data Protection Board (EDPB), GDPR (EU) 2016/679 (Articles 5, 6, 7, and 13), and the LOPDGDD-3/2018 (Article 6), it should be interpreted that consent is only valid if it is explicit.

WHAT ARE COOKIES?

Cookies are small data files received by a terminal from the visited website, used to record certain browsing interactions on a website and to store data that can later be updated or retrieved. They store information about users’ browsing behaviors collected through continuous observation of their browsing habits, which makes it possible to develop a specific profile to display advertising based on it.

By duration (how long they remain active):

  • Session cookies: Designed to collect and store data while the user is on a webpage/App. They are typically used to store information needed only once to provide the service requested by the user (e.g., a list of products purchased) and expire at the end of the session.

  • Persistent cookies: Data remain stored in the terminal and can be accessed and processed for a period defined by the cookie’s controller, which may range from a few minutes to several years. It is essential to assess whether the use of persistent cookies is necessary, as privacy risks could be mitigated using session cookies. If persistent cookies are installed, we recommend keeping their duration to the minimum needed for their intended purpose.

Website owners have two legal obligations under current regulations: transparency and explicit user consent.

Depending on your business activity, business model, and scope of responsibility, it is recommended to carry out a review of the cookies that are used, either internally or with the help of specialized entities.

3. LINK FOR COOKIE IDENTIFICATION

It is advisable that the information on how cookies are managed (including how to revoke consent and delete cookies) be accessible and permanently available at all times on the relevant website, application, or online service.
